• Any disputes between users and merchants

5.3 User Responsibility

Users are solely responsible for verifying the terms and conditions of any offers before making purchases. You acknowledge that your primary relationship regarding any transaction is with the merchant, not with CouponSwan.

• LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES
• DAMAGES RESULTING FROM YOUR USE OR INABILITY TO USE THE SERVICE
• DAMAGES RESULTING FROM ANY THIRD-PARTY CONDUCT OR CONTENT
• DAMAGES RESULTING FROM UNAUTHORIZED ACCESS TO YOUR DATA OR COMMUNICATIONS

8.3 Damage Cap

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

These Terms shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law principles.
